    Thank you for booking your fishing trip with Cedros Sportfishing With Toro.

    By clicking the “Book” button, making a reservation through any of the communication or booking methods provided by Cedros Sportfishing With Toro, or making an advance payment, deposit, pre-reservation payment, or any other payment related to the services offered by Cedros Sportfishing With Toro, the customer (“the Client”) acknowledges, understands, and agrees to be bound by these Terms and Conditions, including the cancellation, rescheduling, transfer, payment, and refund policies established in our Refund and Returns Policy.

    Nature of the Services

    Cedros Sportfishing With Toro provides sport fishing services and related recreational activities in accordance with applicable local and federal laws and regulations.

    Services may include, but are not limited to, sport fishing trips, boat transportation, fishing equipment, captain and/or crew services, and other services specifically included in the reservation confirmed with the Client.

    The specific services included in each reservation will depend on the trip, package, season, availability, and conditions communicated to the Client at the time of booking.

    Customer Guarantees

    As a condition of making a reservation, the Client represents and guarantees that:

    • The Client is at least 18 years of age or is legally authorized to make the reservation and accept these Terms and Conditions.
    • The Client has the legal capacity and authority to enter into a binding agreement.
    • All information provided during the reservation process is true, accurate, current, and complete.
    • The Client will provide accurate information regarding the number of people participating in the fishing trip.
    • The Client has informed, or will inform, all members of their group of these Terms and Conditions, including the inherent risks associated with sport fishing and marine activities.
    • The Client and all members of their group understand that participation in sport fishing activities requires compliance with all safety instructions provided by the captain, crew, and/or representatives of Cedros Sportfishing With Toro.
    • The Client is responsible for ensuring that all members of their group meet any applicable age, physical, medical, or other requirements necessary to participate in the fishing trip.

    Upon confirmation of the reservation, the Client enters into an agreement to receive the services specified in the reservation.

    The Client may not bring additional persons who are not included in the confirmed reservation without prior authorization from Cedros Sportfishing With Toro. Cedros Sportfishing With Toro reserves the right to refuse service to unauthorized additional participants, without obligation to provide a refund for the affected reservation.

    Responsibility and Inherent Risks

    The Client acknowledges and accepts that sport fishing and marine activities involve inherent risks, including but not limited to exposure to the ocean, waves, currents, weather conditions, boat movement, slippery surfaces, fishing equipment, hooks, lines, fish, marine animals, boarding and disembarking from vessels, and other circumstances associated with marine and fishing activities.

    The Client voluntarily assumes the risks inherent in participating in the fishing trip and agrees to follow all safety instructions provided by the captain and crew.

    The Client is responsible for acting carefully and responsibly and for following all instructions provided by Cedros Sportfishing With Toro, the captain, and crew.

    The Client will be responsible for any damage caused intentionally or negligently by the Client or any member of their group to the boat, fishing equipment, property, or equipment belonging to Cedros Sportfishing With Toro or third-party service providers.

    Cedros Sportfishing With Toro shall not be responsible for circumstances beyond its reasonable control, including, but not limited to, weather conditions, ocean conditions, wind, waves, currents, storms, natural phenomena, port closures, government restrictions, mechanical emergencies, fishing conditions, changes in fish activity, or other circumstances that may affect the operation or results of the fishing trip.

    The Client acknowledges that sport fishing is a recreational activity and that Cedros Sportfishing With Toro does not guarantee a specific quantity, species, size, or catch of fish.

    Fishing conditions and results are naturally variable and depend on factors beyond the control of Cedros Sportfishing With Toro.

    Weather and Natural Conditions

    The safety of the Client, the captain, and the crew shall always be the priority.

    Cedros Sportfishing With Toro reserves the right to modify, postpone, shorten, or cancel a fishing trip when, in the reasonable judgment of the captain or Cedros Sportfishing With Toro, weather, ocean, navigation, mechanical, governmental, or other safety conditions make it unsafe or impractical to operate the trip.

    When a trip must be canceled by Cedros Sportfishing With Toro due to weather or other circumstances beyond its reasonable control, the Client may be offered the option to reschedule the trip or transfer the amount paid to another available date, subject to availability and the applicable conditions communicated by Cedros Sportfishing With Toro.

    No guarantee is made regarding fishing conditions, fish availability, or the quantity or quality of the catch.

    Payment, Reservation and Balance

    By making a reservation and paying an advance, the Client agrees to the terms of the reservation and to complete the corresponding payment according to the payment schedule established for the trip.

    A reservation is not considered fully confirmed until the required payment or deposit has been received by Cedros Sportfishing With Toro.

    The Client is responsible for completing the remaining balance within the payment period communicated at the time of booking.

    Failure to complete the required payment within the established period may result in cancellation of the reservation and loss of the amounts paid, subject to the cancellation and transfer policies contained in our Refund and Returns Policy.

    Cedros Sportfishing With Toro reserves the right to modify prices for future reservations. Once a reservation has been confirmed, the price applicable to that reservation will be the price agreed upon at the time of booking if the payment is in full, unless otherwise expressly communicated and accepted by the Client.

    Force Majeure

    Cedros Sportfishing With Toro shall not be responsible for the inability of the Client to attend the fishing trip due to circumstances beyond the control of Cedros Sportfishing With Toro.

    This may include, but is not limited to, illness, transportation delays, flight cancellations, personal emergencies, changes in travel plans, weather conditions affecting the Client’s ability to travel, or other circumstances affecting the Client personally.

    In such circumstances, the Client must comply with the cancellation and change deadlines established in our Refund and Returns Policy.

    Cancellation by Cedros Sportfishing With Toro

    Cedros Sportfishing With Toro reserves the right to cancel or modify a fishing trip when necessary due to weather, ocean conditions, safety concerns, governmental restrictions, port closures, mechanical problems, or other circumstances beyond its reasonable control.

    When Cedros Sportfishing With Toro cancels a trip for reasons within the scope of this section, the Client may be offered a rescheduling option or credit toward another available fishing trip.

    If a trip cannot reasonably be rescheduled and a refund is authorized, the applicable refund will be determined based on the circumstances of the cancellation.

    Third-Party Services

    Certain services related to a fishing trip may involve third-party providers, including transportation, lodging, permits, equipment, or other services.

    Cedros Sportfishing With Toro will make reasonable efforts to coordinate such services; however, the Client acknowledges that third-party services may be subject to their own terms, conditions, schedules, availability, and cancellation policies.

    Cedros Sportfishing With Toro shall not be responsible for losses caused by the independent acts, omissions, delays, cancellations, or failures of third-party providers beyond the reasonable control of Cedros Sportfishing With Toro.

    Financial Information, Insurance and Payment Authorization

    The Client acknowledges that personal and financial information may be required to process and confirm a reservation.

    The Client is responsible for providing correct and complete information when making a reservation.

    The Client authorizes Cedros Sportfishing With Toro and its authorized payment processors to process the payments necessary to confirm and complete the reservation using the payment method provided by the Client.

    Cedros Sportfishing With Toro shall not be responsible for losses resulting from incorrect financial or payment information provided by the Client.

    The Client is responsible for obtaining any travel, medical, accident, or other insurance that the Client considers appropriate for participation in the fishing trip.

    Damage to Property and Equipment

    The Client is responsible for any damage to the boat, fishing equipment, facilities, or other property caused by the Client or any member of their group through intentional acts, misuse, negligence, or reckless behavior.

    If a claim for damages arises, Cedros Sportfishing With Toro may provide the Client with information and evidence supporting the claim.

    The Client will have the opportunity to review and dispute the claim with reasonable supporting evidence before any applicable charge is processed.

    Use of Image

    By making a reservation and participating in activities with Cedros Sportfishing With Toro, the Client acknowledges that photographs and/or videos may be taken during the fishing trip for promotional, advertising, website, and social media purposes.

    To the extent permitted by applicable law, the Client authorizes Cedros Sportfishing With Toro to use photographs or videos in which the Client may appear for promotional purposes, unless the Client expressly communicates in writing before the trip that they do not authorize such use.

    Acceptance of These Terms and Conditions

    By making a reservation, paying a deposit, pre-reservation amount, or any other payment related to a fishing trip with Cedros Sportfishing With Toro, the Client acknowledges that they have read, understood, and accepted these Terms and Conditions.

    The Client is responsible for informing all members of their group of the applicable Terms and Conditions and the risks associated with participation in the fishing trip.

    Cedros Sportfishing With Toro reserves the right to update or modify these Terms and Conditions for future reservations. The version applicable to a reservation will be the version in effect and communicated at the time the reservation is made.
